The pharmaceuticals industry is a prominent area of SCLO’s practice. Our experience in this sector includes advising companies at various levels of the supply chain, including manufacturing, trade, imports, and exports.
We have particularly extensive experience in advising international pharmaceuticals companies, at all stages, whether they are established and operational in Sudan, or are at the exploratory and planning stages of their ventures in Sudan.
Our work in this burgeoning sector includes advising companies on all aspects of their contracts, including legal and regulatory. We guide our clients through complicated issues that are common in the sector, such as foreign exchange regulations, compliance, construction, acquisition, distribution, employment, and dispute resolution.
Our work has included:
Leading on the acquisition by Hikma Pharmaceuticals of Elie Pharmaceuticals, one of Sudan’s largest pharmaceuticals factories. As Sudanese Legal Counsel, SCLO delivered the full range of services involved in the acquisition. This included advising on compliance with the Rules of the London Stock Exchange in accordance with Sudanese rules and regulations, real estate, intellectual property, central bank regulations (with an emphasis on foreign exchange regulations), construction contracts, corporate guarantees, and distribution and agency agreements. Through its enterprising approach, SCLO achieved a precedent-setting decision granting distribution rights to a foreign-owned company.
